Terms of Service

These Terms of Service (hereinafter "ToS") define the terms of access and use of The Peak Post website (hereinafter "the Site").

The Site is a participatory social platform allowing:

• content promotion via a system called Peak Post,
• voluntary user contributions to gain attention,
• daily redistribution of a portion of contributions in the form of solidarity credits,
• support for recognized associations and NGOs, freely chosen by users.

Access to the Site and its use implies full and complete acceptance of these ToS.

The user acknowledges having read the rules before any use of the Site, and in particular before any financial contribution.

Access to the Site is reserved for persons:

• at least 18 years old,
• with legal capacity to make online payments.

The publisher reserves the right to suspend or delete an account in case of non-compliance with these ToS.

To use certain features, the user must create a personal account.

The user agrees to:

• provide accurate and up-to-date information,
• create only one personal account,
• maintain the confidentiality of their credentials.

Any activity performed from an account is deemed to be performed by its holder.

The Site offers a content promotion system based on voluntary financial contribution:

• a user can contribute to place their content in Peak Post (place #1),
• other users can then contribute more to take this place,
• each contribution is final and non-refundable,
• visibility is time-limited according to the rules displayed on the platform.

Payments made on the Site correspond exclusively to:

• a voluntary contribution,
• intended to obtain temporary visibility (Peak Post),
• and to feed a solidarity redistribution mechanism.

Amounts are clearly displayed before validation.

Any financial contribution requires explicit user confirmation.

No refunds are possible, except in case of proven technical malfunction attributable to the Site.

The Site is based on a principle of collective redistribution.

Every day:

• all financial contributions constitute the Total Contribution of the day,
• 50% of this Total Contribution is redistributed equally among all users with an active account,
• this redistribution is made in the form of solidarity credits, automatically added to each user's account.

Credits received:

• cannot be withdrawn as real money,
• cannot be transferred between users,
• can only be used to support recognized associations and NGOs available on the platform.

Each user is free to:

• choose which associations or NGOs they wish to allocate their credits to,
• distribute their credits among several organizations,
• support causes of their choice without constraint.

The user understands and accepts that credits received have no personal monetary value and are exclusively intended for solidarity use.

The user agrees to:

• not post illegal, defamatory, hateful or offensive content,
• not manipulate or abuse the bidding system,
• respect other users and platform rules.

The user is solely responsible for:

• the content they publish,
• the amounts they choose to contribute,
• their use of the Site.

The publisher cannot be held responsible for:

• users' financial decisions,
• consequences related to Site use,
• temporary service interruptions,
• behaviors or content posted by other users.

The Site is provided "as is", without warranty of result or performance.

The publisher reserves the right to:

• suspend an account,
• delete an account,
• block access to the Site,

in case of:

• fraud or attempted fraud,
• creation of multiple accounts,
• system abuse,
• non-compliance with these ToS.

No compensation can be claimed in case of justified sanction.

Users' personal data is processed in accordance with the Site's Privacy Policy.

In accordance with applicable legislation, the user has the right to:

• access,
• rectify,
• delete their personal data.

All elements of the Site (concept, design, texts, logos, features) are protected by intellectual property law.

Any unauthorized reproduction or exploitation is strictly prohibited.

These ToS may be modified at any time.

Users will be informed of significant changes.

Continued use of the Site after changes constitutes acceptance of the new ToS.

These ToS are governed by Swiss law.

In the event of a dispute, the competent courts are those of the Canton of Vaud, unless otherwise provided by mandatory legal provisions.
